Terms and Conditions For Customers

TIMELINE FOR DISPOSAL OF LOAN APPLICATIONS SCHEME

The timeline for loan process starts from the date of submission of 6th payment and complete set of documents by the applicant and the time taken by the applicant for submitting documents and/or furnishing information sought by the Fundwell Support Services Foundation will not be taken into account for the purpose of timeline indicated above. We shall endeavour, at all times, to deliver within the indicated timelines, barring in situations and circumstances that are beyond the control of the Fundwell Support Services Foundation.

The Borrower hereby irrevocable and unconditionally agree to abide by the following terms and conditions: –

The Fundwell Support Services Foundation may disburse the Loan or any part thereof (“Disbursement”) at its own discretion. Notwithstanding anything contained herein:

The borrower is aware that if disbursement/further drawdown is not accepted or not enchased by the borrower/previous within the period of 90 days then Fundwell Support Services Foundation shall be entitled to the following:-

The Fundwell Support Services Foundation shall have the right to recall the credit facility or stop further drawdown/ disbursement.

Borrower won’t be entitled for refund of any processing fees, service charge and /or other charges/fees/costs (if any).

All these charges (if applicable) would be payable to the Fundwell Support Services Foundation whether or not the Credit facility has been drawn by the borrower.

The Fundwell Support Services Foundation may not disburse at any time; any amount under the Loan unless the following conditions are complied with in the sole discretion of the Fundwell Support Services Foundation:

This Agreement is duly executed and delivered to the Fundwell Support Services Foundation by the Borrower;

The Borrower’s submission to the satisfaction of the Fundwell Support Services Foundation of a of employment from his employer and his statements;

Any other document or writing as the Fundwell Support Services Foundation may require in its sole discretion.

The Borrower(s) having furnished such Security as may be required by the Fundwell Support Services Foundation, as more detailed in the annexure, in a form and manner satisfactory to the Fundwell Support Services Foundation

The Fundwell Support Services Foundation may, at its sole discretion and on such terms as to foreclosure fees, etc., as it may prescribe from time to time, permit foreclosure of the loan at the request of the Borrower subject to the applicable laws and if permitted by the Fundwell Support Services Foundation, the Borrower shall pay to the Fundwell Support Services Foundation such Foreclosure charges mentioned in the Annexure, as amended from time to time.

Provided that the Borrower shall not have a right to foreclose the Loan up to the date of payment of 6 EMIs commencing from the repayment of the Loan.

The Loan, interest, additional interest, default interest any other charges, dues and monies payable, costs and expenses reimbursable as outstanding from time to time and whether any of them due or not, are hereinafter collectively referred to as “Outstanding Balance”.

The Borrower shall pay interest on the Loan, the unpaid due interest and all other outstanding charges and monies (except the default interest), at the rate of interest in the Schedule hereto, on the outstanding daily balance from the date of disbursement, compoundable at monthly rests.

The Fundwell Support Services Foundation in its sole discretion would be entitled to change the said rate interest from time to time including on account of changes made by the Fundwell Support Services Foundation, which would be intimated to the Borrower(s) and would be binding upon the Borrower(s).

The Borrower shall also pay and bear all interest tax, if any, as applicable from time to time.

The borrower is abid to make a deposit of their chosen amount that is given in the slab of lokamatri.co.in which is the website of Fundwell Support Services Foundation for 6 months continuously failing to which the borrower cannot ask for the refund of his/her deposited money.

Should the borrower want to start his /her profile again then they have to start new with fresh documents and again a payment of six months.

The borrower here by agrees that Fundwell Support Services Foundation can make any changes in the terms and conditions for this agreement and shall/will have no objection to them. In the mean while the refreshed conditions will be informed to the borrower through our chosen medium of contact within a time span of 60 days of amendment.

The Borrower(s ) shall repay the Loan and pay the interest that is due from time to time by way of equated monthly instalments (EMIs) as or as may be by the Fundwell Support Services Foundation from time to time(time being the essence of the contract).

Borrower is not advised to pay any cash to our agent directly.

In any case the borrower pays any cash to our agent our company will not be responsible.

We advise our borrower to pay to our company directly on our authorised platform.

Choosing a nominee is optional if chosen then the following terms are applied :-

1) If there is an accidental demise of the borrower during payment of pre- loan deposits then the entire sum of money will be restored to the nominee.

2) In case of death of borrower after loan approval or ongoing loan then the nominee has to return the loan amount along with minus pre-loan deposits .

The Borrower has perused, understood and agreed to the Fundwell Support Services Foundation’s method of calculating EMI’s as also the appropriation thereof into principal and interest.

The payment of all the monies by the Borrower including EMI’s shall be made on or before the respective due dates, at such place as the Fundwell Support Services Foundation may require, without any set-off or counterclaim or withholding or deduction(save as required by law in which case the amount payable by the Borrower to the Fundwell Support Services Foundation shall be increase to the amount which after making such deduction or withholding equals the original due amount as if no withholding or deduction were required), by way of one or more modes and instruments including post-dated cheques “PDCs”), Standing Instructions(SI)/Electronic Clearing System(ECS) instructions/other mode/instrument, as acceptable to the Fundwell Support Services Foundation from time to time.

If any due date falls on a non business day of the Fundwell Support Services Foundation, the payment shall be made by the Borrower on the immediate preceding business day of the Fundwell Support Services Foundation

In case of cheques/ other instrument, the payment shall be deemed to have been made by the Borrower only at the point of time the sum is credited and realized fully in the Fundwell Support Services Foundation’s account irrespective of the date of instrument or time of receipt or presentation of instrument.

In case of any default, the Borrower shall without prejudice to the Fundwell Support Services Foundation’s right and remedies, pay additional/default interest at the rate mentioned in the Schedule hereto/Application or as may be prescribed by the Fundwell Support Services Foundation

Over and above the then applicable rate of interest till full payment is made/default is cured. This liability shall not act as for any default.

The Borrower(s) shall pay to the Fundwell Support Services Foundation, the charges, fees, commissions, etc., on the Schedule hereto/Application or as by the Fundwell Support Services Foundation from time to time, within such time or upon occurrence of such events as and if not then forthwith upon demanded by the Fundwell Support Services Foundation

All other present and future costs and expenses, taxes as applicable form time to time), any related levy, stamp duty, in all jurisdictions, in relation to this/other documents/any transaction pursuant thereto, irrespective of who the is, shall be borne and payable solely by the Borrower, including for creation, enforcement, preservation of security, recovery, initiation/defending/pursuing any legal proceedings/ action by the Fundwell Support Services Foundation In case of any such sums if paid or incurred by the Fundwell Support Services Foundation, the Borrower shall be liable to reimburse the same to the Fundwell Support Services Foundation in full forthwith.

Any Payments made by/on behalf/for the Borrower or any realizations in relation to the Loan, security, shall be appropriated towards the Outstanding Balance and /or Liabilities (as hereinafter) in the following order:

Firstly, towards costs and expenses incurred by the Fundwell Support Services Foundation;

Secondly, towards any charges, commissions, fees, taxes, levies (wherever applicable);

Thirdly, towards additional/default interest;

Fourthly, towards interest;

Fifthly, towards principal amount(s). Any statement of account furnished by the Fundwell Support Services Foundation shall be accepted by and be binding on the Borrower(s) and shall be conclusive proof of the correctness of the amounts mentioned therein except for any manifest error therein.

The Borrower that the Goods and Service Tax Number (GSTIN) (if applicable) provided in the application form/ declaration is true and correct.

The Borrower agrees and undertakes that the applicable tax rate will be determined using the information provided by the Borrower and the input tax credit (ITC) will be available to the Borrower (if applicable) based on the GSTIN and the related information/details provided by the Borrower in the application form/ declaration.

The Borrower further agrees and undertakes that the Borrower shall not hold the Fundwell Support Services Foundation liable for any loss of ITC arising due to incomplete, erroneous or wrong details pertaining to GST provided by the Borrower in the application form/ declaration.

The Borrower also further agrees and undertakes that if the Borrower fails to furnish GSTIN, then the Borrower shall be treated as unregistered for Gods and Service Tax (GST) purpose and no credit of GST will be provided to the to the Borrower.

Notwithstanding anything stated in any document, the continuation of the Loan shall be at sole an absolute discretion of the Fundwell Support Services Foundation and the Fundwell Support Services Foundation at any time in its sole discretion and without assigning any reason call upon the Borrower to pay the Outstanding Balance and upon such demand by the Fundwell Support Services Foundation, the Borrower shall, within 48 hours of being so called upon, pay the whole of the Outstanding Balance to the Fundwell Support Services Foundation without any delay or demur.

The Fundwell Support Services Foundation may at its own discretion and upon Borrower’s request, also the Borrower for the insurance premium of insurance policy taken by Borrowers as per Borrower’s own wish from any insurance company of Borrower’s choice, which sum(s) shall be added to the principal amount under the Loan and all the terms and conditions shall be additionally applicable thereto.

All expenses, charges, fees, taxes etc., as applicable on any such insurance shall be incurred and paid by the Borrower, however, in case paid by the Fundwell Support Services Foundation on Borrowers behalf, the Borrower shall reimburse the same to the Fundwell Support Services Foundation within 24 hours of the Fundwell Support Services Foundation’s demand.

The Borrower shall instruct the insurance company to add the Fundwell Support Services Foundation as loss payee in any such insurance policy. 02 (Fundwell Support Services Foundation COPY).

Insurance is non-mandatory and offered only to customer who voluntarily chooses to opt for the same. In case if the loan is cancelled, the insurance policy will also get cancelled automatically and the certificate of insurance (if received/issued) will remain cancelled/ revoked.

The Borrower shall furnish and create such security from time to time in favour of or for the benefit of the Fundwell Support Services Foundation, of such value, in such form and in such manner, as may be deemed fit by the Fundwell Support Services Foundation, forthwith upon so required by the Fundwell Support Services Foundation

The Fundwell Support Services Foundation shall also have the right to stipulate any other and further terms and conditions that it may deem fit at any time prior to or after the grant of the Loan; which shall be binding on the Borrower.

Each of the Borrowers represent(s) and warrant(s) that (which shall be deemed to have been repeated to the Fundwell Support Services Foundation on the date of Disbursement and on each date thereafter till entire repayment) :

The Borrower is a citizen of India and a major (in terms of age) and is of sound mind and is competent to contract and enter into and perform his/ her obligations contemplated under this document/other document/in respect of the Loan;

There is no impediment or restriction, whether under law, judgment, order, award, contract or otherwise, for any of the Borrowers entering into and/or performing any of the transactions contemplated by this/other documents/in respect of the Loan and all approvals and consents, wherever necessary have been duly obtained and are and will continue to be in full force;

The execution hereof constitutes legal, valid and binding obligations of the Borrower.

That there is no Event of Default existing;

All declarations made by Borrower are true and complete and no material information has been suppressed /withheld.

The Borrower(s) agree that if there are two or more Borrower(s), the Borrower(s) liabilities under this Loan terms and conditions shall be joint and several.

Except in favor of the Fundwell Support Services Foundation, sell, and license, let lease, transfer, alienate, and dispose of in any manner.

whatsoever, surrender or otherwise encumber any of its assets, rights, title or interest, receivables, or any part thereof; or create, facilitate or permit to exist any charge, encumbrance or lien of any kind whatsoever over any of its property or grant any option or other right to purchase, lease or otherwise acquire, any such assets or part thereof;

Permit of effect any direct or indirect change in the legal of beneficial ownership or control;

Change /cease/retires from/terminate/resign from the present employment/profession /business disclosed in the Applications; or changes, terminate or open any Fundwell Support Services Foundation account.

The following events shall constitute events of default (each an “Event of Default”), and upon the occurrence of any of them the entire Outstanding Balance shall become immediately due and payable by the Borrower and further enable the Fundwell Support Services Foundation inter alia to recall the entire Outstanding Balance and/or enforce any security and transfer/sell the same and/or take, initiate and pursue any actions/proceedings as deemed necessary by the Fundwell Support Services Foundation to recovery of the dues;

Failure on Borrower’s part to perform any of the obligations or terms or conditions or covenants applicable in relation to the Loan including under this/other documents including non – payment in full of any part of the Outstanding Balance when due or when demanded by the Fundwell Support Services Foundation;

Any misrepresentations or misstatement by the Borrower; or

Occurrence of any circumstance or event which adversely affects Borrower’s ability/capacity to pay/repay the Outstanding Balances or any part thereof or perform any of the obligations;

If any attachment, distress, execution or other process against the Borrowers/its assets or any of the security is threatened, enforced or levied upon by any person; or

Notwithstanding anything to the contrary in this document or any other document or any other document/arrangement:

In respect of all and any of Borrower’s present and future liabilities to the Fundwell Support Services Foundation, its group entities, associate entities, parent, subsidiaries, any of their branched (collectively “Relevant Entities”), whether under this document or under any other obligation/loan facilities/borrowing/document, whether such liabilities are/be crystallised, actual or contingent, primary of collateral or several or jointly with others, whether in same currency or different currencies, whether as principle debtor and/or as guarantor and/or otherwise howsoever (collectively “Liabilities”), each of the Fundwell Support Services Foundation and the Relevant Entities shall in addition to any general lien or similar right to which any of them as Fundwell Support Services Foundation may be entitled by law, practice, custom or otherwise, have a and special lien on all the Borrower’s present and future stocks,shares,securities, property, book debts, all moneys in all accounts whether current, savings overdraft, or other deposits, held with or in custody, legal or constructive, with the Fundwell Support Services Foundation and/or any Relevant Entities, now or in future, whether in same or different capacity of the Borrower, and whether severally or jointly with others, whether for any Fundwell Support Services Foundation relationship, safe custody, collections, or otherwise whether in same currency or different currencies; and

Separately, each of the Fundwell Support Services Foundation and the Relevant Entities shall have the and express right to, without notice to and without consent of the Borrower, set – off, transfer, sell realize, adjust appropriate all such amounts in all accounts (whether prematurely or upon maturity as per the Fundwell Support Services Foundation’s discretion), securities,amounts and property as aforesaid for the purpose or realizing or against any of dues in respect of any of the Liabilities whether ear- marked for any particular Liability or not, combine or consolidate all or any of accounts of the Borrower and set- off any monies, whether of same type or nature or not and whether held in same capacity or not including upon happening of any of the events of default mentioned in any of the documents pertaining to the respective Liabilities or upon any default in payment of any part of any the Liabilities.

The Fundwell Support Services Foundation and the Relevant Entities shall be deemed to have and hold and continue to have charge on any assets including on any assets including any deposit on which security has been/will be created in respect of the Loan, as security also for any of the other Liabilities and all the rights and powers vested in the Fundwell Support Services Foundation in terms of any security or charge created for the Loan shall be available to the Fundwell Support Services Foundation and/or the Relevant Entities also in respect of such other Liabilities, irrespective of the fact whether the Loan is at any time outstanding, repaid or not and even after the Loan has been repaid or prepaid.

The Fundwell Support Services Foundation shall at any time, without any consent of or notice to the Borrower (s) be entitled to securitize, sell assign, discount or transfer all or any part of the Fundwell Support Services Foundation’s rights and obligations under the Loan, this document or any other document, to any person (s) and in such manner and on such terms as the Fundwell Support Services Foundation may decide. Borrower shall not be entitled to directly or indirectly assign or in any manner transfer, whether in whole or part, any rights, or obligation under the Loan, this / other document.

The Fundwell Support Services Foundation shall also be entitled to communicate in any manner it may deem to or with any person or persons including guarantors, person giving reference to loan, with a view to receiving assistance of such person or persons in recovering the defaulted amounts including but not limited to visiting the property and/or any place of work of the Borrower.

The Fundwell Support Services Foundation shall be entitled at its discretion to engage/avail of, at the risk and cost of the Borrower, services of any person/third party service provider/agent/ agency, for anything required to be done for/in relation to/pursuant to the Loan, including collections, recovery of dues, enforcement of security, getting or verifying any information of the Borrower/ assets, and any necessary or incidental lawful acts /deeds/matters and things connected thereto, as the Fundwell Support Services Foundation may deem .

The Borrower agrees that the Fundwell Support Services Foundation has an unconditional right to revoke and/or recall the entire loan facility if the disclosure as mentioned in this clause is found to be false.

In the Event of Default, the Fundwell Support Services Foundation shall also be entitled to communicate in any manner it may deem to or with any person or persons including guarantors, person giving reference to loan, with a view to procure assistance of such person or persons in recovering the defaulted amounts including but not limited to visiting the property and/or any place of work of the Borrower.

Force Majeure -The Borrower shall be liable to perform or its obligations at all point of time and shall not delay/postpone performance, its obligations in whole or in part, even on the ground of any force majeure event such as acts of God, cyclones, earthquakes, wars, riots, strikes, orders of governmental or other statutory authorities, national emergency, or any other similar causes.

The Fundwell Support Services Foundation shall have the right to not return the Application, the photographs, information and documents submitted by the Borrower.

The Fundwell Support Services Foundation shall, without notice to or without any consent of the Borrower, be absolutely entitled and have full right, power and authority to make disclosure of any information relating to Borrower including personal information, details in relation to documents, Loan, defaults, security, obligations of Borrower, to the Credit Information Bureau of India (CIBIL) and/or any other governmental / regulatory / statutory or private agency/entity, credit bureau, RBI, the Fundwell Support Services Foundation’s other branches/ agencies, service providers, other institutions, and third parties, any assigns/potential assignees or transferees, who may need the information and may process the information, publish in such manner and through such may be deemed necessary by the publisher/the Fundwell Support Services Foundation/RBI, including publishing the name as part of wilful defaulter’s list from time to time, as also use for KYC information credit risk analysis, or for other related purposes. In this connection, the Borrower waives the privilege of privacy of contract.

The Fundwell Support Services Foundation shall have the right, without notice to or without any consent of the Borrower, to approach, make enquires, obtain information, from any person including other entities/credit bureaus, Borrower’s employer/family members, any other person related to the Borrower, to obtain any information for assessing track record, credit risk, or for establishing contact with the Borrower or for the purpose of recovery of dues from the Borrower.

Any notice, approvals, instructions, demand and other communications given or made by the Fundwell Support Services Foundation shall be deemed to be duly given and served if send by Normal post, courier, registered post, facsimile electronic mail, personal delivery, sms or by pre-paid registered mail addressed to the Borrower’s address, phone/ mobile number, fax number or email as given in the Applications (or at the address changed on which the Fundwell Support Services Foundation’s acknowledgment is duly obtained as hereinafter mentioned) such notice and service shall be deemed to take effect on the third working day following the date of posting thereof in case of normal post, courier, registered post, at the time of delivery if given by personal delivery, upon receipt of a transmission report if given by facsimile, upon sending the electronic mail or sms if given by electronic mail or sms.

The Borrower undertakes to keep the Fundwell Support Services Foundation informed at all times in writing of any change in the mailing address, email id, phone and mobile number (s) as provided in the Applications and to obtain the Fundwell Support Services Foundation’s written acknowledgment on the intimation given to the Fundwell Support Services Foundation for any such change.

Any change in mailing address, telephone numbers and other contact details must be intimated to Fundwell Support Services Foundation, quoting the Loan Account Number along with a valid documentary proof

Kindly ensure that your account is funded with sufficient funds at least a day prior to your EMI date, to avoid bounce charges

Non-payment of any of the charges levied will be reported to the Credit information company (including CIBIL) and will affect the credit score.
If any of the deemed address proofs is provided, then within 3 months from date of disbursal, the updated Officially Valid Document with the current address should be submitted by the customer to the Fundwell Support Services Foundation
Repayment Schedule: Repayment Schedule provides the amount of each EMI, due dates and break-up between principal and interest components. It also provides the outstanding principal realization of each installment. Please note that you can access the repayment schedule by logging into the Customer Portal

IMPORTANT: The outstanding principal should not be taken as the only obligation to the Company under this Loan Agreement. Prepayment penalty, other charges, if applicable, all other monies that may be due and payable by the borrower to Fundwell Support Services Foundation, including its subsidiaries/affiliates/assignee on any account whatsoever, whether present of future, including any liability of the Borrower as a surety or co-obligor either singly or along with any other person are also payable at the time of full and final settlement.

I hereby submit my Aadhaar number, as issued by Government of India; to Fundwell Support Services Foundationand voluntarily give my consent to link it to all my accounts / relationships (existing and new) maintained with Fundwell Support Services Foundation in my individual capacity and / or as an authorized signatory.

I authorise Fundwell Support Services Foundation to map my Aadhaar number at NPCI to enable me to receive Direct Benefit Transfer (DBT) from Government of India in the specified Savings account.

I understand that if more than one Benefit transfer is due to me, I will receive all Benefit Transfers in this account.

I, holder of the stated Aadhaar number, hereby voluntarily give my consent to Fundwell Support Services Foundation to obtain and use my Aadhaar number, Name and Fingerprint/Iris and my Aadhaar details to authenticate me with UIDAI as per Aadhaar Act, 2016 and all other applicable laws.

Fundwell Support Services Foundation has informed me that my Aadhaar details and identity information would only be used for demographic authentication, validation, e-KYC purpose, OTP authentication including; for availing Fundwell Support Services Foundation services, operation of my accounts / relationships and for delivery of subsidies, benefits and services and / or any other facility relating to Fundwell Support Services Foundation operations.

Fundwell Support Services Foundation has informed that my biometrics will not be stored / shared and; will be submitted to Central Identities Data Repository (CIDR) only for the purpose of authentication.

I have been given to understand that my information submitted to the Fundwell Support Services Foundation herewith shall not be used for any purpose other than mentioned above.

I also authorize Fundwell Support Services Foundation To link & authenticate my Aadhaar number to all my accounts / relationships with the Fundwell Support Services Foundation,both existing and as may be opened in future.

I will not hold Fundwell Support Services Foundation or any of its officials responsible in case of any incorrect information provided by me.

I understand and accept that Fundwell Support Services Foundation maintains the web-site http://www.lokamatri.co.in (going ahead referred to as “the Site” or “the Fundwell Support Services Foundation website”) to provide visitors with information about Fundwell Support Services Foundation, its services and products and to facilitate communication with Fundwell Support Services Foundation and availing its services. I also accept that visitors to the Site are required to read the below terms, and use of the Site constitutes my acceptance and agreement to be bound by such terms, and the changes therein to the Website Usage Terms from time to time, relating to my usage of the website as communicated and made available on the Fundwell Support Services Foundation website.

I am aware and accept that all information, content, materials, products (including, but not limited to text, content, photographs, graphics, video and audio content) on the website is protected by copyright in the favour of Fundwell Support Services Foundation under applicable copyright laws and is also protected otherwise under general intellectual property law.

I understand and accept that all information submitted by me through the Fundwell Support Services Foundation website shall be deemed the property of Fundwell Support Services Foundation, and the Fundwell Support Services Foundation shall be free to use any ideas, concepts, know-how or techniques provided by me at the Site, in any manner whatsoever. On initiating a contact through the Fundwell Support Services Foundation website I agree to being contacted by the Fundwell Support Services Foundation or any other entities with whom the Fundwell Support Services Foundation has entered into an arrangement.

I agree that I shall not copy, reproduce, sell, redistribute, publish, enter into a database, display, perform, modify, transmit, license, create derivatives from, transfer or in any way exploit any part of any information, content, materials, services available from or through the Fundwell Support Services Foundation website, except that which I may download for my own personal, non-commercial use.

I agree that I will not use the Fundwell Support Services Foundation website for any purpose that is unlawful, or prohibited by these Website Usage Terms. I also agree I will not use the Fundwell Support Services Foundation website in any manner that could damage, disable or impair the website or interfere with any other party’s use or enjoyment of the website.

I acknowledge that the software and hardware underlying the Fundwell Support Services Foundation Website as well as other Internet related software which are required for accessing the website are the legal property of the respective Vendors.

The permission given by the Fundwell Support Services Foundation to access the Fundwell Support Services Foundation website will not convey any proprietary or ownership rights in the above software / hardware.

I agree that I shall not attempt to modify, translate, disassemble, decompile or reverse engineer the software / hardware underlying the Fundwell Support Services Foundation website or create any derivative product based on the software / hardware.

I understand and accept that not all the products and services offered on this website are available in all geographic areas and I may not be eligible for all the products or services offered by Fundwell Support Services Foundation on the Site. Fundwell Support Services Foundation reserves the right to determine the availability and eligibility for any product or service.

I am aware that Fundwell Support Services Foundation proposes to use “cookies” (Cookies are small data files that a website stores on my computer.) for storing visitor preferences, profiling visitors and tracking visitor behavior on the Fundwell Support Services Foundation website. By visiting the website I acknowledge, accept and expressly authorize the Fundwell Support Services Foundation for the placement of cookies on my computer.

I understand and accept that Fundwell Support Services Foundation is not responsible for the availability of content or other services on third party sites linked from the Fundwell Support Services Foundation website.

“Force Majeure Event” means any event due to any cause beyond the reasonable control of the Fundwell Support Services Foundation, including without limitations, unavailability of any communication systems, breach, or virus in the processes or payment or delivery mechanism, sabotage, fire, flood, explosion, acts of god, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorised access to computer data and storage devices, computer crashes, malfunctioning in the computer terminal or the systems getting affected by any malicious, destructive or corrupting code or program, mechanical or technical errors/failures or power shut down, faults or failures in telecommunication etc.

I understand and accept Fundwell Support Services Foundation has the absolute discretion to amend or supplement any of the Website Usage Terms at any time and will give prior notice of 30 days for such changes.

Changed Terms and Conditions shall be communicated to me on the Fundwell Support Services Foundation website and by other acceptable modes of communication.

By using the services, I shall be deemed to have accepted the changed Website Usage Terms.

I accept that the Courts in Bhubaneswar alone shall have exclusive jurisdiction as regards any claims or matters arising out of dealings with Fundwell Support Services Foundation, and all disputes will be governed by the laws of India.

I understand and agree that these Website Usage Terms are in addition to, and not in derogation of, the applicable Terms and Conditions relating to my usage of any other Fundwell Support Services Foundation that I may be currently availing or may in the future avail, including without limitation the Net Fundwell Support Services Foundation service.

I agree to abide by the Fundwell Support Services Foundation Terms and Conditions and rules in force and the changes thereto in Terms and Conditions from time to time relating to my account as communicated and made available on the Fundwell Support Services Foundation website.

I agree that the Fundwell Support Services Foundation before opening any deposit account will carry out a due diligence as required under Know Your Customer guidelines of the Fundwell Support Services Foundation I would be required to submit necessary documents or proofs, such as identity, address, photograph and any such information to meet with KYC, AML or other statutory/regulatory requirements.

Further, after the account is opened, in compliance with the extant regulatory guidelines, I agree to submit the above documents again at periodic intervals, as may be required by the Fundwell Support Services Foundation

I agree that, under normal circumstances, the Fundwell Support Services Foundation has the liberty to close my account at any time by giving me at least 30 days notice. However, if the Average Monthly/ Quarterly Balance are not maintained, the Fundwell Support Services Foundation reserves the right to close my account without giving any prior notice.

I agree that the Fundwell Support Services Foundation can at its sole discretion, amend any of the services/facilities given in my account either wholly or partially at any time by giving me at least 30 days notice and/or provide an option to me to switch to other services/facilities.

I agree that any change in my account status or change of address will be immediately informed to the Fundwell Support Services Foundation failing which I shall be responsible for any non-receipt of communication/deliverables or the same being delivered at my old address.

I agree that all instructions relating to my account will be issued to the Fundwell Support Services Foundation as per acceptable mode of communication to the Fundwell Support Services Foundation

I agree that I shall be liable to pay all charges, fees, interest, and costs wherever applicable, which the Fundwell Support Services Foundation may levy with respect to my account or any transaction or services rendered and the same may be recovered by the Fundwell Support Services Foundationby a debit to my account. I agree and acknowledge that in case of non-availability of adequate funds the charges will be debited to the account over a period of time till the entire amount is recovered.

I agree to execute necessary writings in the form and manner as may be required by the Fundwell Support Services Foundation in order to execute my Fax instructions to the Fundwell Support Services Foundation

I agree that the Fundwell Support Services Foundation will send me communications/letters etc. through courier/messenger/mail or through any other mode at its discretion and the Fundwell Support Services Foundation shall not be liable for any delay arising there from.

I agree that the Fundwell Support Services Foundation shall not be liable for any damages, losses (direct or indirect) whatsoever, due to disruption or non availability of any of services/facilities due to technical fault/error or any failure in telecommunication network or any error in any software or hardware systems beyond the control of the Fundwell Support Services Foundation

I agree that the Fundwell Support Services Foundation may disclose, in strict confidence, to other institutions, such Personal Information as may be reasonably necessary for reasons inclusive of:

For participation in any telecommunication or electronic clearing network

In compliance with a legal directive

For credit rating by recognized credit rating agencies

For fraud prevention purposes

To credit information bureaus.

Failure to enforce any rights conferred by these Terms and Conditions or any law shall not be deemed to be a waiver of any such rights or operate so as to the exercise or enforcement thereof at any subsequent time.

All claims, matters and disputes are subject to the exclusive jurisdiction of the competent courts in Bhubaneswar only.

These Terms and Conditions and/or the operations in the accounts of the customer maintained by the Fundwell Support Services Foundation and/or the use of the services provided by the Fundwell Support Services Foundation shall be governed by the laws of the Republic of India and no other nation.

The customer and the Fundwell Support Services Foundation agree to submit to the exclusive Jurisdiction of the Courts located in Bhubaneswar, India as regards any claims or matters arising under these Terms and Conditions.

The Fundwell Support Services Foundation accepts no liability whatsoever, direct or indirect, for non-compliance with the laws of any country other than the Republic of India.

Fundwell Support Services Foundation shall be entitled at its discretion to engage/avail of, at the risk and cost of the customer, services of any person/third party service provider/agent/agency, for anything required to be done for/in relation to/pursuant to any of the products/services offered, including collections, recovery of dues, enforcement of security, getting or verifying any information of the customer/assets, and any necessary or incidental lawful acts/deeds/matters and things connected thereto, as the Fundwell Support Services Foundation may deem fit.

The Fundwell Support Services Foundation shall have the right to not return the application, the photographs, information and documents submitted by the customer.

any assignees/potential assignees of transferees, who may need the information and may process the information, publish in such manner and through such medium as may be deemed necessary by the publisher/ Fundwell Support Services Foundation, including publishing the name as part of wilful defaulter list from time to time, as also use for KYC information verification, credit risk analysis, or for other related purposes.

In this connection, the customer waives the privilege of privacy and privacy of contract.

The Fundwell Support Services Foundation shall have the right, without notice to or without any consent of the customer, to approach, make enquiries, obtain information, from any person including other Fundwell Support Services Foundations/finance entities/credit bureaus, family members, any other person related to the customer, to obtain any information for assessing track record, credit risk, or for establishing contact with the customer or for the purpose of recovery of dues from the customer.

In case any personal information or sensitive information is collected by the Fundwell Support Services Foundation, the same shall be dealt with in accordance with the privacy policy of the Fundwell Support Services Foundation which is available on the website of the Fundwell Support Services Foundation

Fundwell Support Services Foundation reserves the right to record telephonic conversations with customers for quality control purposes.

Notwithstanding the documentation and account opening form provided, the Fundwell Support Services Foundation reserves the right to accept / reject your application.

The Fundwell Support Services Foundation decision in this regard would be final.

Any loans/facilities, other Fundwell Support Services Foundation products, may be made available through the internet Fundwell Support Services Foundation platform or any similar platform of the Fundwell Support Services Foundation(platforms through which the customer/borrower can access/monitor the account by use of the customer/log-in id and password) and the Fundwell Support Services Foundation may use such platform for providing the customers/borrowers the facility to complete online application as well as enter into/make the loan documents online.

Of the password; and that the Fundwell Support Services Foundation shall not be required to check the identity of the person operating the Fundwell Support Services Foundation account at any point of time or his mental or physical stability.

Notwithstanding the documentation and account opening form provided, the Fundwell Support Services Foundation reserves the right to accept / reject your application.

The Fundwell Support Services Foundation decision in this regard would be final.

I hereby submit my Aadhaar number, as issued by Government of India; to Fundwell Support Services Foundation and voluntarily give my consent to link it to all my accounts / relationships (existing and new) maintained with Fundwell Support Services Foundation in my individual capacity and / or as an authorized signatory.

I authorise Fundwell Support Services Foundation to map my Aadhaar number at NPCI to enable me to receive Direct Benefit Transfer (DBT) from Government of India in the specified Savings account.

I understand that if more than one Benefit transfer is due to me, I will receive all Benefit Transfers in this account.

Fundwell Support Services Foundation has informed me that my Aadhaar details and identity information would only be used for demographic authentication, validation, e-KYC purpose, OTP authentication including; for availing Fundwell Support Services Foundation, operation of my accounts / relationships and for delivery of subsidies, benefits and services and / or any other facility relating to Fundwell Support Services Foundation operations.

I have been given to understand that my information submitted to the Fundwell Support Services Foundation herewith shall not be used for any purpose other than mentioned above.

I also authorize Fundwell Support Services Foundation to link & authenticate my Aadhaar number to all my accounts / relationships with the Fundwell Support Services Foundation, both existing and as may be opened in future.

I will not hold Fundwell Support Services Foundation or any of its officials responsible in case of any incorrect information provided by me.

Any loans/facilities, other Fundwell Support Services Foundation products, may be made available through the Fundwell Support Services Foundation platform or any similar platform of the Fundwell Support Services Foundation (platforms through which the customer/borrower can access/monitor the account by use of the customer/log-in id and password) and the Fundwell Support Services Foundation may use such platform for providing the customers/borrowers the facility to complete online application as well as enter into/make the loan documents online.

Every usage and operation of the Fundwell Support Services Foundation or any such other platform using such customer id and password, including in cases of online loan processes from time to time, should be deemed to be usage and operation personally by the customer/borrower himself and in physically and mentally stable state nothwithstanding any loss, theft, hacking etc. of the password; and that the Fundwell Support Services Foundation shall not be required to check the identity of the person operating the internet Fundwell Support Services Foundation account at any point of time or his mental or physical stability.

I agree that I shall indemnify and hold the Fundwell Support Services Foundation harmless against all actions, claims, demands, proceedings, losses, damages, costs, charges and expenses whatsoever which the Fundwell Support Services Foundation may at any time incur, sustain, suffer or be put to as a consequence of or by reason of or arising out of providing any of the services or due to any negligence/mistake/misconduct on my part or breach or non-compliance by me of any of the Terms and Conditions relating to any of the services or by reason of the Fundwell Support Services Foundation in good faith taking or refusing to take action on any instruction given by me.

The Fundwell Support Services Foundationshall also be entitled to communicate in any manner it may deem to or with any person or persons including guarantors, person giving reference to loan, with a view to receiving assistance of such person or persons in recovering the defaulted amounts including but not limited to visiting the property and/or any place of work of the Borrower.

The Fundwell Support Services Foundation shall at any time, without any consent of or notice to the Borrower (s) be entitled to securitize, sell assign, discount or transfer all or any part of the Fundwell Support Services Foundation’s rights and obligations under the Loan, this document or any other document, to any person (s) and in such manner and on such terms as the Fundwell Support Services Foundation may decide. Borrower shall not be entitled to directly or indirectly assign or in any manner transfer, whether in whole or part, any rights, the or obligation under the Loan, this / other document.

the Fundwell Support Services Foundation and the Relevant Entities shall be deemed to have and hold and continue to have charge on any assets including on any assets including any deposit on which security has been/will be created in respect of the Loan, as security also for any of the other Liabilities and all the rights and powers vested in the Fundwell Support Services Foundation in terms of any security or charge created for the Loan shall be available to the Fundwell Support Services Foundation and/or the Relevant Entities also in respect of such other Liabilities, irrespective of the fact whether the Loan is at any time outstanding, repaid or or not and even after the Loan has been repaid or prepaid.

separately, each of the Fundwell Support Services Foundation and the Relevant Entities shall have the and express right to, without notice to and without consent of the Borrower, set – off, transfer, sell realize, adjust appropriate all such amounts in all accounts (whether prematurely or upon maturity as per the Fundwell Support Services Foundation’s discretion), securities, amounts and property as aforesaid for the purpose or realizing or against any of dues in respect of any of the Liabilities whether ear- marked for any particular Liability or not, combine or consolidate all or any of accounts of the Borrower and set- off any monies, whether of same type or nature or not and whether held in same capacity or not including upon happening of any of the events of default mentioned in any of the documents pertaining to the respective Liabilities or upon any default in payment of any part of any the Liabilities.

The loan is to be repaid in Equated Monthly Instalments (EMIs) over the tenure of the loan. The repayment of instalment commences from a date specified in the sanction letter. The liability to the Fundwell Support Services Foundation will be extinguished only when the outstanding of the loan becomes Nil, on payment of residual amount, if any.

In the event of default i.e. if the EMI amount due is not paid by due date, the customer will be sent reminders at his/her cost from time to time for payment of any outstanding on his loan account, by post, fax, telephone, email, SMS messaging and/or through third parties appointed for collection purpose to remind, follow-up and collect dues. Any third party so appointed, shall adhere to the Indian Fundwell Support Services Foundations Association’s (IBA) code of conduct on debt collection.

PENAL INTEREST: if the irregularity exceeds EMI or Instalment amount, for a period of one month, then penal interest would be charged @5% per month (over and above the applicable interest rate) on the overdue amount for the period of default. If part instalment or part EMI remains overdue, then penal interest should not be levied.

Kindly ensure that your account is funded with sufficient funds at least a day prior to your EMI date, to avoid bounce charges

Non-payment of any of the charges levied will be reported to the Credit information company (including CIBIL) and will affect the credit score.

If any of the deemed address proofs is provided, then within 3 months from date of disbursal, the updated Officially Valid Document with the current address should be submitted by the customer to the Fundwell Support Services Foundation
